2. About these terms
This website is operated by Mi Climate Limited. Contact info@mi-climate.co.uk about these terms or a project. These terms cover use of the website and the request process. Your written quote and agreed project terms set out the scope of any work. Nothing here limits mandatory consumer rights.
3. Enquiries, quotes and visit requests
Submitting an enquiry or selecting a preferred date and time does not confirm a booking, reserve availability or form a contract for work. An email acknowledgement confirms receipt or acceptance for sending, not a confirmed appointment. We must agree the scope, price and date with you.
Website descriptions and AI recommendations are general information. Room-estimator results and fire damper labour estimates are not final project quotes. PPM for small or large commercial buildings is quoted individually, with the package scope and visit frequency agreed for the site. VAT treatment, equipment, materials and any additional charges must be made clear in your written quote before you agree.
4. Agreeing a project
Check your written quote, contact details and site information before accepting. A service agreement is formed when both you and Mi Climate confirm acceptance of the written scope and price. Changes to the work, price or schedule must be agreed, not assumed from an online request.
You must have authority to commission work at the property and provide accurate information about access, equipment and known hazards. We will agree practical arrangements with you. Work may need to be paused or rescheduled if access or safety conditions prevent it; any resulting changes or reasonable costs must be discussed and agreed, subject to your legal rights.
5. Deposits, invoices and online payments
For all new agreed projects, following owner approval, the deposit is 50% of the full approved quote total for projects costing up to and including £10,000.00, and 10% for projects costing more than £10,000.00. Exactly £10,000.00 requires a 50% deposit. The agreed total, including any applicable VAT and agreed charges, is the basis for the threshold and deposit calculation and must be clear in your written quote.
Invoice links show the amount requested. A remaining-balance invoice can be issued after the deposit is paid; the payment due date and arrangements are stated in your invoice or written agreement.
If you cancel after the first 14 days following formation of the project agreement, our policy provides for retention of 5% of the full agreed project price, not 5% of the deposit, for work booking, diary scheduling and project administration. This must be disclosed and agreed before the contract is made. It is not an automatic forfeiture: retention applies only where lawful and, for consumers, only to the extent fair and proportionate to evidenced costs or losses actually incurred, taking account of savings and reasonable mitigation. If the justified amount is less than 5%, we retain only that lower amount. We explain any deduction and refund the remaining deposit, subject to any separate lawful charge for work or goods already supplied; the same cost will not be charged twice.
This retention does not apply when we cancel the work or override statutory cancellation rights, including any legally extended cancellation period, or remedies for faulty goods or deficient services. Within the first 14 days we do not apply this booking and administration retention; any separate lawful charge for services expressly requested and actually provided during a statutory cancellation period remains subject to the consumer protections below. New terms do not retrospectively change an existing project agreement.
Mi Climate Limited is the seller and remains responsible for the agreed HVAC services, billing, applicable taxes, customer support and refunds. Our secure online checkout is processed by Stripe. Stripe calculates and collects applicable tax at checkout; Mi Climate remains responsible for tax registration, filing and remittance. Payment card details are entered directly in secure checkout and are not collected in our enquiry or booking forms.
For payment questions, cancellation or refund requests, contact info@mi-climate.co.uk with your invoice reference. Our refund policy explains the service cancellation rights that apply. Nothing in these terms or the checkout terms limits mandatory consumer rights.
A payment is recorded as received only after verified payment-provider confirmation. Screens marked “Test payments only” use test checkout and do not charge real money. A deposit is not automatically non-refundable.
6. Service standards and your rights
Services must be performed with reasonable care and skill. Any goods supplied must meet applicable legal requirements, including satisfactory quality, fitness for purpose and conformity with description. Agreed guarantees do not replace statutory rights.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded. Website information does not replace professional inspection or emergency assistance. Stop using unsafe equipment if safe to do so and seek qualified help.
7. Website use and intellectual property
Use the website lawfully and follow our acceptable use policy. Mi Climate branding and website material must not be copied or used commercially without permission, except as permitted by law. You may save your own quote, request and invoice information.
We aim to keep information accurate and the website available, but errors or interruptions can occur. Contact us if an amount or detail appears wrong before proceeding with payment. External websites and checkout services have their own terms.
8. Suspension and termination
We may suspend or terminate access to the website, account features or AI finder where reasonably necessary because of a material breach of these terms, unlawful use, fraud or spam, intellectual property infringement, security interference, or repeated or serious breaches of our acceptable use policy. Security interference includes malware, unauthorised probing, abusive scraping and attempts to bypass access controls. Access restrictions will be proportionate to the risk; where appropriate we will explain the reason and allow an opportunity to resolve a remediable breach.
If an agreed payment is overdue, we may suspend or terminate contracted services only where permitted by your written project agreement and applicable law, after any required notice and opportunity to remedy the non-payment. Immediate protective restrictions may be necessary where there is a security or fraud risk. Restricting website access does not automatically cancel an existing project, forfeit a deposit or remove your cancellation, refund or other statutory rights. Any ending of a project and the treatment of outstanding payments will follow the agreed terms and applicable law.
9. Questions, complaints and governing law
Please email info@mi-climate.co.uk with your request or invoice reference so we can investigate a concern. Cancellation and refund requests are covered by the refund policy.
These terms are governed by the law of England and Wales. Consumers retain any mandatory protections and rights to bring proceedings in their home jurisdiction where applicable. Changes to website terms do not retrospectively change an already agreed project.
